Override Thursday: Voting Rights and Marriott

Voting Rights Restoration Override Vote Postponed

The Maryland Senate special ordered (i.e. postponed) the vote on the Governor’s veto of the bill to restore the voting rights of ex-felons to a later date. The House overrode the Governor’s veto yesterday. The lead sponsors are Sen. Joan Carter Conway and Del. Cory McCray.

The Senate President stated forthrightly on the floor that this was to allow time for the appointment of a replacement to former Sen. Karen Montgomery (D-14). Rumor has it that many General Assembly Democrats are not thrilled about the timing or handling of this appointment.

Keep Marriott in Maryland

The Maryland Senate took a major step toward keeping Marriott headquarters in Maryland by overriding the Governor’s veto of a bill that requires the same tax rate levied on hotel rooms sold by third-party hotel bookers as by the hotels themselves.

This seemingly obvious fairness–the major request of the Marriott Corporation whose headquarters Montgomery County is working hard to retain–had the Governor cowering in fear that it might be cast as a tax increase. It’s evidence that the Governor’s ideological passion exceeds his desire to keep major companies in Maryland.

As the tally sheet shows, the Senate achieved the 29 votes required to override a veto with one to spare despite Sen. Montgomery’s retirement. A real victory for Senate Budget and Taxation Vice Chair Rich Madaleno who pushed hard for the bill.

Marriott OverrideTwo vote switchers from the original bill are Sen. Addie Eckardt (R-Eastern Shore) and Sen. John Astle (D-Anne Arundel). Eckardt’s switch was not surprising, as Republicans tend to want to rally around the Governor to support a veto.

In contrast, Astle is a member of the Democratic leadership team, so his vote to support the Governor was a shock. Indeed, this Montgomery blogger wonders if Montgomery Senate Democrats might return the favor by voting to uphold the veto on funding for Anne Arundel–except that the Speaker wants it.

UPDATE: Sen. C. Anthony Muse also flipped, which is interesting since Gaylord Marriott, located at National Harbor in his district, in Prince George’s made it a top priority. Additionally. Sens. DeGrange and Peters–both Democrats–switched from red on the original bill to voting to green on this vote.

Republican Senate Conservatism Varies–But Not Too Much

GOP SenToday, 7S looks at Republicans using the data provided by Boris Shor and Nolan McCarty of state legislator ideology. Remember that a more positive score indicates a more conservative senator, so the bottom of the table are the most conservative. Put another way, the closer to zero, the more moderate the senator. These scores are for the legislator’s entire career in the General Assembly and include House as well as Senate service.

Republican scores range from 0.330 for Sen. George Edwards (R-Garrett, Allegany and Washington) and 1.200 for Senator-Elect Gail Bates (R-Howard). (Three incoming Republican senators do not have scores because they have never served in the General Assembly.) In contrast, the most progressive Democrat, Sen. Rich Madaleno (D-Montgomery), has a score of -1.864 and the most moderate Democrat, Sen. Jim Brochin (D-Baltimore County) receives a rating of -0.285.

Two of the three most moderate Republicans represent Western Maryland–Edwards and Sen. Christopher Shank (R-Washington). However, the two Eastern Shore Republicans are not close ideologically with Senator-Elect Addie Eckardt (R-Mid Shore) more moderate than Sen. Steve Hershey (R-Upper Shore).

Similarly, the two Anne Arundel senators are not an ideological matched set. Sen. Ed Reilly (R-Anne Arundel) is the second most conservative senator while Sen. Bryan Simonaire (Anne Arundel) is more moderate, though the ideological distance is smaller than for the two Shore Republicans.

Perhaps most critical is that all Republicans are notably more conservative than all Democrats. The distance between the most moderate Democrat and Republican (0.615) is greater than that between the most conservative Republican, Senator-Elect Bates, and the second most “moderate” Republican, Senator-Elect Eckardt. And even the most moderate Republcian, Sen. Edwards, is closer to all but three Republicans than the most moderate Democrat.

New Senate Set for Greater Polarization

Past posts have mentioned that the new Maryland General Assembly will be more polarized than the previous one. But what is the measurable impact of the election? Fortunately, since many new senators were formerly delegates, there are measures of their ideology in relation to other legislators.

Using the same dataset provided by Boris Shor and Nolan McCarty of state legislator ideology mentioned in previous posts, this post examines directly the ideology of incoming senators as compared to the people they are replacing. (The scale ranges from around -1.9 for the most liberal Democrat to 1.2 for the most conservative Republican with moderates closest to zero.)

In two cases, measures are not available but the impact is clear. Sens. Roy Dyson and Norm Stone were among the most very moderate members of the Democratic Caucus. They are being replaced by conservative Republicans. These changes will leave the Democrats more liberal and quite possibly also make the Republicans more conservative.

Two cases of Republicans being replaced by fellow Republicans will clearly make the GOP Caucus more conservative. Del. Gail Bates is more conservative than Alan Kittleman. Similarly, Del. Wayne Norman is also more conservative than Sen. Barry Glassman.

There are seven cases with less dramatic changes. Despite the fierce primary, Del. Michael Hough’s voting record has not been dramatically more conservative than Sen. Michael Brinkley. Theirs may be a difference more of style than of substance. But a more confrontational style likely exacerbates polarization.

In Howard County, Del. Guy Guzzone is a bit more liberal than outgoing Sen. Jim Robey. Del. Susan Lee is just a tad more liberal than AG-Elect Brian Frosh. Retiring Sen. Verna Jones-Rodwell has a somewhat less liberal voting record than Del. Shirley Nathan-Pulliam. The impact of the replacement of conservative Sen. Nancy Jacobs by Bob Casilly is less clear but it would be surprising if he turns out to be less conservative than Jacobs.

In two cases, changes may mildly reduce polarization. During her previous service in the House, Cheryl Kagan was a bit less liberal than outgoing Sen. Jennie Forehand. Similarly, Del. Addie Eckardt is a tad less conservative than defeated Sen. Richard Colburn. She is also viewed as a more thoughtful and productive member of the General Assembly than Colburn, who focused on scoring political points rather than shaping legislation.

The Overall Impact

Excluding the three seats won by people who have not served previously in the General Assembly, here are the calculations for the overall ideology of the Senate.

Median D: -1.107 (change of -0.005).
Mean D: -1.115 (change of -0.047).

Median R: 0.881 (change of 0.124).
Mean R: 0.883 (change of 0.062).

Increase in Polarization (Medians): 0.13 (7% increase).
Increase in Polarization (Means): 0.11 (6% increase).

Remember that these calculations underestimate increases in polarization because they exclude the two cases that will have the most dramatic impact–the replacement of Dyson and Stone–especially on the Democratic side as they were among the five most moderate Democrats in the Senate.

Polls Support 7S Predictions

Red Maryland recently published the results of a poll of upcoming Republican primaries. The results are in line with my recent predictions for the primaries in two Eastern Shore districts. Incumbent Sen. Steve Hershey leads former Del. Richard Sossi in District 36.  Del. Addie Eckhardt has a good chance to unseat incumbent Sen. Richard Colburn in neighboring District 37.

The key caveat–and why I am not making any ratings changes based on these polls–is that the number of respondents in each district is low. In the Hershey-Sossi race, there are just 87 respondents and in the Colburn-Eckardt race, there are only 58. Another problem is that figuring out who will vote in these low turnout events is not easy.

Indeed, based on this many respondents, the difference in support for Colburn and Eckardt is not statistically significant. Put another way, there is a more than 1 in 20 chance that the difference in support among actual voters is zero or that Colburn actually leads Eckardt.

On the other hand, the sample size and the differences in the levels of support for the two candidates are large enough in the Hershey-Sossi race to indicate that Sossi probably really does trail Hershey. The small number of respondents renders the actual size of Hershey’s lead unclear–the range around the estimated level of support for either is huge. But one can say that Hershey is ahead by some amount greater than zero with reasonable certainty.

Colburn v. Eckardt in Top Senate Primaries III

This is the third in a series on the top Senate primaries in the State (Part I and Part II).

District 37 (R): This primary matchup between Sen. Richard Colburn and Del. Adelaide (Addie) Eckardt is almost as personal as the one previewed yesterday in neighboring District 36. Colburn and Eckardt have served together in the General Assembly since 1995. According to The Quinton Report, Colburn walked up to Eckardt and on the night she filed and said “You used to be my friend.”

Colburn was elected in 1982 to the first of two terms in the House of Delegates. In 1990, he sought the Republican congressional nomination and came in third with 12% of the vote in a highly fractured contest. When very conservative Democratic Sen. Frederick Malkus, Jr., retired, Colbun won election to the Senate in 1994, easily winning the primary and then the general by 10%.

Eckardt is the most serious challenger Colburn has faced since gaining his Senate seat. Beyond being smart and likeable, she has also represented most of the same people as Colburn for nearly two decades. They are both known quantities.

Colburn also goes into the primary with less money than Eckardt as he has $32K in his campaign account to her $44K. Neither can raise money during the session, so they will have little time to raise much more before the primary occurs in June.

One advantage held by Colburn is that he already represents all of District 37. Eckardt represents District 37B, which elects two of the three delegates. Much of the advantage, however, is illusory. District 37A was drawn as a majority-black district, and so has comparatively few Republicans. In 2012, only 18.5% of registered Republicans lived in 37A–only around one-half what one would expect if Republicans were evenly distributed.

Moreover, Eckardt has decided to strike when Colburn is at his weakest. He has been under scrutiny for ethics questions, having spent “more than $40,000 in meals, gas, lodging, flowers and Baltimore Orioles tickets” out of his campaign funds, as reported in the Daily Times. The article has led to editorials calling for Colburn to “clean up his finances.”

On top of that, Colburn has had a very public divorce with allegations of an affair with his aide. His now ex-wife was even thinking of running against him but agreed to support him politically once they agreed to a divorce settlement.

Eckardt also appears more respected in the General Assembly than Colburn. While the number of Republican senators remains few, Colburn has somehow never managed to hold a Republican leadership position according to his bio. Eckardt chaired the House Republican Caucus for five years. However, it’s well known that a lack of respect in the Assembly often has little relation to political support at home.

In her remarks to the press, Eckardt expressed an interest in policy, even speaking about making health care reform work, rather than the usual staple of Republican talking points:

“Even though there’s been a lot of difficulty with the exchange, this is one of the most exciting times to be here in Annapolis because we’ve had 140,000 new people get on the Medicaid medical assistance who didn’t have heath care ­before, and that’s really important,” ­Eckardt said. “But we have to make sure it’s cost-effective and we have to make sure that, as we go forward, it’s a functioning system, because otherwise we would just be putting more money in technology and not getting the results. I’d rather see money go to care for individuals.”

Yet, she remains a firm conservative, especially on social questions. Colburn tends to position himself more as a regional champion, playing on the Shore as a victim of the State.

Needless to say, this will be an exciting contest. They’re both from Dorchester so neither has a home bailiwick. If anyone can topple Colburn, it should be Eckardt. Both seats in 37B will be open, so this race will likely feature high turnout amid an unusual level of interest in state legislative contests. Rating: Toss Up.

UPDATE: A friend on the Eastern Shore says that Colburn provides very good constituent services and has a reputation of being very responsive to individual requests, which will aid him in his hour of need in this tough primary.
