{"id":13650,"date":"2020-08-26T07:00:00","date_gmt":"2020-08-26T11:00:00","guid":{"rendered":"https:\/\/www.theseventhstate.com\/?p=13650"},"modified":"2020-08-25T18:42:56","modified_gmt":"2020-08-25T22:42:56","slug":"moco-doesnt-want-you-to-know-what-it-pays-for-covid-tests","status":"publish","type":"post","link":"https:\/\/www.theseventhstate.com\/?p=13650","title":{"rendered":"MoCo Doesn\u2019t Want You to Know What it Pays for COVID Tests"},"content":{"rendered":"\n<p><em>By Adam Pagnucco.<\/em><\/p>\n\n\n\n<p>Stories in <a href=\"https:\/\/bethesdamagazine.com\/bethesda-beat\/coronavirus\/county-opens-two-covid-19-test-sites-unsure-why-state-issued-order-against-rockville-lab\/\">Bethesda Beat<\/a> and the <a href=\"https:\/\/www.washingtonpost.com\/local\/coronavirus-montgomery-maryland-virginia-dc\/2020\/08\/18\/28865186-e147-11ea-8181-606e603bb1c4_story.html\">Washington Post<\/a> have confirmed a disturbing aspect of the dispute between Montgomery County and Rockville lab AdvaGenix, with which the county had a contract to provide COVID tests that was later terminated. Specifically, the county\u2019s contract with AdvaGenix prohibits it from disclosing to the public how much it is obligated to pay the company.<\/p>\n\n\n\n<p>Bethesda Beat <a href=\"https:\/\/bethesdamagazine.com\/bethesda-beat\/coronavirus\/county-opens-two-covid-19-test-sites-unsure-why-state-issued-order-against-rockville-lab\/\">filed a Maryland Public Information Act (MPIA) request<\/a> with the county to obtain its contracts with AdvaGenix and Bio-Reference Laboratories, another testing lab. According to Bethesda Beat, the county took 53 days to answer the request despite plainly having the contracts in its possession, a violation of the 30-day requirement in state law. Both contracts had pricing terms redacted.<\/p>\n\n\n\n<p>The images below are from the AdvaGenix contract as <a href=\"https:\/\/www.washingtonpost.com\/context\/advagenix-contract\/06f6011e-f8a4-479e-bff6-3cd1cf2cee97\/?itid=lk_inline_manual_4\">posted online by the Washington Post<\/a>. He has a point: <a href=\"https:\/\/www.marylandattorneygeneral.gov\/OpenGov Documents\/Chapter3.pdf\">according to the state\u2019s Attorney General<\/a>, the MPIA indeed \u201cprevents disclosure of trade secrets, confidential commercial or financial information, and confidential geological or geophysical information, if that information is furnished by or obtained from any person or governmental unit.\u201d However, that doesn\u2019t mean that the county had to agree to specific contract provisions keeping pricing confidential. In fact, the county\u2019s <a href=\"https:\/\/data.montgomerycountymd.gov\/Government\/Maryland-Public-Information-Act-MPIA-Request-Respo\/99ya-kjjr\/data\">MPIA response database<\/a> is full of requests for and disclosures of county contract information, including pricing schedules.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"673\" height=\"905\" src=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2020\/08\/Keefe-Pricing-Schedule.png\" alt=\"\" class=\"wp-image-13654\" srcset=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2020\/08\/Keefe-Pricing-Schedule.png 673w, https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2020\/08\/Keefe-Pricing-Schedule-223x300.png 223w\" sizes=\"auto, (max-width: 673px) 100vw, 673px\" \/><\/figure>\n\n\n\n<p><em>A contractor\u2019s pricing schedule for inmate phone calls released in response to an MPIA request.<\/em><\/p>\n\n\n\n<p>Pricing secrecy benefits a county contractor in two ways. First, if the company\u2019s pricing is protected from disclosure, that makes it harder for a potential competitor to undercut it in the future. Second, secrecy makes it easier for a contractor to charge higher prices to other customers. For example, if another county knows that the company is charging MoCo X dollars per unit, why would it agree to pay more? This is all very helpful to contractors but not so helpful to taxpayers.<\/p>\n\n\n\n<p>MoCo\u2019s secrecy agreement occurs in a context of widespread variation of COVID test prices. The New York Times reported that <a href=\"https:\/\/www.nytimes.com\/2020\/06\/16\/upshot\/coronavirus-test-cost-varies-widely.html\">COVID test charges in Texas vary from $27 to $2,315 per test<\/a>. That range is facilitated by the common practice of hospitals and insurers to keep COVID test prices secret, as MoCo does. Last year, President Donald Trump issued an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/executive-order-improving-price-quality-transparency-american-healthcare-put-patients-first\/\">executive order<\/a> requiring hospitals \u201cto publicly post standard charge information, including charges and information based on negotiated rates and for common or shoppable items and services, in an easy-to-understand, consumer-friendly, and machine-readable format using consensus-based data standards that will meaningfully inform patients\u2019 decision making and allow patients to compare prices across hospitals.\u201d When the American Hospital Association <a href=\"https:\/\/www.nytimes.com\/2020\/06\/23\/upshot\/hospitals-lost-price-transparency-lawsuit.html\">sued to keep prices secret<\/a>, it <a href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2019cv3619-35\">lost in U.S. District Court<\/a>. (It will no doubt appeal.)<\/p>\n\n\n\n<p>Montgomery County Government is actually more anti-transparency in the case of COVID test pricing than Donald Trump. Think about that.<\/p>\n\n\n\n<p>Unlike out-of-pocket costs paid by hospital patients, MoCo\u2019s testing costs don\u2019t directly hit the wallets of those being tested. But they do hit residents\u2019 wallets through their tax bills. On top of that, possible litigation with AdvaGenix looms. The fact that MoCo taxpayers do not know how their tax dollars are being spent is highly problematic.
