{"id":12061,"date":"2019-03-04T07:00:06","date_gmt":"2019-03-04T12:00:06","guid":{"rendered":"https:\/\/www.theseventhstate.com\/?p=12061"},"modified":"2019-03-04T00:27:33","modified_gmt":"2019-03-04T05:27:33","slug":"its-no-myth-that-airbnbs-arrive-with-adus","status":"publish","type":"post","link":"https:\/\/www.theseventhstate.com\/?p=12061","title":{"rendered":"It&#8217;s No Myth that AirBnBs arrive with ADUs"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Supporters of accessory dwelling units (ADUs) claim that it\u2019s\na \u201cmyth\u201d that they will be turned into AirBnBs or other short-term rentals. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, the law is not always a good guide to what\nhappens.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Portlandia<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Portland is often cited as the promised land by ADU\nsupporters. Like Montgomery County, <a href=\"https:\/\/www.portlandoregon.gov\/bds\/index.cfm?a=68689\">Portland\u2019s ADU guidelines<\/a>\nstate that they are \u201cdesigned for residential occupancy independent of the\nprimary dwelling unit.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But according to a survey prepared for a 2018 report prepared by the Institute for Sustainable Solutions (ISS) at Portland State University, <a href=\"https:\/\/www.pdx.edu\/sustainability\/sites\/www.pdx.edu.sustainability\/files\/iss\/Portland%20ADU%20Survey%20Report%20June%202018.pdf\">31% of ADUs are for short-term housing, defined as stays as less than one month<\/a>. Only 56% are being used as someone\u2019s primary residence. ISS is staunchly pro-ADU, so it\u2019s hard to throw dirt on the statistics as part of a nefarious anti-ADU plot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While intended as residential dwelling units, many are used\nas AirBnBs or the equivalent. The survey did not present statistics on what\npercentage were in compliance with Portland\u2019s permitting requirements for\nshort-term rentals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Illegal AirBnBs <\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Councilmember Hans Riemer laudably wants to focus ADUs on\nhousing rather than hotel space. In a recent email blast, he touted \u201cthe units\ncould not be used for short-term rentals (i.e., Airbnb)\u201d under his proposed\nlegislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, illegal AirBnBs already exist with impunity in Montgomery County. Here is a photo of one <a href=\"https:\/\/www.airbnb.com\/rooms\/29906311?guests=1&amp;adults=1\">operating in Bethesda<\/a>:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"827\" height=\"1024\" src=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB3-827x1024.jpg\" alt=\"\" class=\"wp-image-12064\" srcset=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB3-827x1024.jpg 827w, https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB3-242x300.jpg 242w, https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB3-768x951.jpg 768w, https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB3.jpg 1242w\" sizes=\"auto, (max-width: 827px) 100vw, 827px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"> A complaint was filed about this illegal AirBnB with the County last April. The complaint was \u201cresolved\u201d by kicking it over to the Department of Housing and Community Affairs (DHCA).<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img loading=\"lazy\" decoding=\"async\" width=\"360\" height=\"531\" src=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB1-e1551675876744.jpg\" alt=\"\" class=\"wp-image-12062\" srcset=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB1-e1551675876744.jpg 360w, https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2019\/03\/AirBnB1-e1551675876744-203x300.jpg 203w\" sizes=\"auto, (max-width: 360px) 100vw, 360px\" \/><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The county database shows no sign of an ongoing investigation. Apparently, they got a license after the complaint was filed but the current usage is not in compliance for these sorts of rentals. One also wonders if the county or the state is even capturing the appropriate tax from this usage since they don&#8217;t know it exists despite advertisements on AirBnB.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Increasing the burden on county enforcement authorities through the addition of hundreds of ADUs per year seems an unlikely way to solve the problem.
