the Allegations Against Blair"},"content":{"rendered":"<p><em>By Adam Pagnucco.<\/em><\/p>\n<p>Businessman David Blair is the only candidate in the County Executive race to be targeted by both negative mail and <a href=\"https:\/\/www.theseventhstate.com\/?p=10949\">two negative<\/a> <a href=\"https:\/\/www.theseventhstate.com\/?p=11111\">TV ads<\/a>.\u00a0 The combined expenditures for these mailers and TV ads <a href=\"https:\/\/www.theseventhstate.com\/?p=11149\">now total over a half million dollars<\/a>, making Blair the only Executive candidate to take fire on that financial scale.<\/p>\n<p>How do we evaluate these attacks?<\/p>\n<p>First, your author has a background in evaluating evidence of corporate conduct.\u00a0 For sixteen years, I was a strategic researcher in the labor movement.\u00a0 One of my jobs was to investigate companies who were targets of union organizing campaigns.\u00a0 I performed dozens of these investigations and it was painstaking, tedious work.\u00a0 The basic descriptives of the company \u2013 its business lines, affiliates, history, executives, finances, work locations, project experience, client lists, political contributions and so on \u2013 were a necessary predicate for researching its safety, labor, environmental, legal and media records.\u00a0 Some of the dossiers I compiled were over a hundred pages and required months of travel to assemble.\u00a0 I had three primary tasks: gather the information, determine its utility and craft it into communication pieces that were truthful, relevant and avoided the risk of defamation litigation. \u00a0Over the years, I uncovered extraordinarily bad behavior on the part of employers including but not limited to sexual harassment, racial discrimination, threatening deportation to block union organizing campaigns, environmental destruction, bid rigging, intentionally exposing employees to lethal working conditions to save money and a LOT more.\u00a0 That research background gives me a standard of comparison for some of the allegations against Blair and it is partially through that prism that I write today\u2019s post.<\/p>\n<p>Here are the main allegations against Blair.<\/p>\n<p><strong>He is a former Republican with a spotty voting record.<\/strong><\/p>\n<p>This is true and <a href=\"https:\/\/www.washingtonpost.com\/local\/md-politics\/democratic-candidate-david-blair-has-frequently-skipped-voting-in-primaries\/2017\/12\/19\/bb30aada-e1a5-11e7-8679-a9728984779c_story.html?utm_term=.b61ea16815ee\">Blair has admitted to it<\/a>.\u00a0 Blair is one of two former Republicans running for office in MoCo this year.\u00a0 The other is Council District 1 candidate Meredith Wellington, who was a <a href=\"http:\/\/montgomerycountymd.granicus.com\/MetaViewer.php?view_id=150&amp;clip_id=343&amp;meta_id=113121\">Republican member of the Planning Board as recently as 2007<\/a>, <a href=\"https:\/\/www.washingtonpost.com\/local\/md-politics\/david-blair-self-funding-candidate-says-montgomery-needs-entrepreneur-at-the-helm\/2018\/06\/14\/54bd57e4-5f86-11e8-b2b8-08a538d9dbd6_story.html?utm_term=.0375d424592b\">four years after Blair became a Democrat<\/a>.\u00a0 Those who would pass judgment on Blair for this should hold Wellington to the same standard assuming that either is to be judged at all.<\/p>\n<p><strong>He is a self-funder who has not held political office.<\/strong><\/p>\n<p>This is also true.\u00a0 Blair is one of MANY self-funding Democrats who have run for office, including Senators <a href=\"https:\/\/www.opensecrets.org\/members-of-congress\/summary?cid=N00007364\">Dianne Feinstein<\/a>, <a href=\"https:\/\/ctmirror.org\/2011\/04\/28\/blumenthal-joins-ranks-self-funded-candidates\/\">Richard Blumenthal<\/a>, <a href=\"https:\/\/www.opensecrets.org\/members-of-congress\/summary?cid=N00004309&amp;cycle=Career\">Herb Kohl<\/a> and <a href=\"http:\/\/content.time.com\/time\/nation\/article\/0,8599,46866,00.html\">Jon Corzine<\/a> and House members <a href=\"https:\/\/www.theseventhstate.com\/?p=10730\">John Delaney<\/a>, <a href=\"http:\/\/articles.latimes.com\/1998\/mar\/25\/news\/mn-32572\">Jane Harman<\/a> and <a href=\"https:\/\/coloradopolitics.com\/colo-governors-race-polis-pours-nearly-5-million-into-bid-as-kennedy-johnston-set-fundraising-records\/\">Jared Polis<\/a>.\u00a0 Then there is party-hopping, self-funding former New York City Mayor Michael Bloomberg, who now <a href=\"https:\/\/everytown.org\/press\/new-gun-violence-prevention-group-everytown-for-gun-safety-unites-mayors-moms-and-millions-of-americans-on-new-paths-to-victory-state-capitols-corporate-responsibility-voter-activation\/\">spends millions to promote gun control<\/a> and <a href=\"https:\/\/mobile.nytimes.com\/2018\/06\/20\/us\/politics\/mike-bloomberg-democrats-election.html\">plans to spend $80 million to elect Democratic House candidates<\/a>, acts for which he is praised by the left.\u00a0 And liberal self-funder <a href=\"https:\/\/www.opensecrets.org\/overview\/topself.php?cycle=2006\">Ned Lamont<\/a>, who famously challenged Connecticut Senator Joe Lieberman from the left in 2006, was <a href=\"https:\/\/ctmirror.org\/2018\/05\/19\/democrats-endorse-lamont-block-ganim-primary\/\">just endorsed by the Democratic Party for Governor<\/a>.\u00a0 All of these politicians self-financed millions in their races so if Blair is to be criticized, so must all the rest.\u00a0 In any event, <a href=\"https:\/\/www.theseventhstate.com\/?p=10730\">only one self-funder above the $200,000 level has won office from MoCo in the last twelve years.<\/a>\u00a0 Our county\u2019s history demonstrates that money can never substitute for a real agenda that connects with voters.<\/p>\n<p><strong>One of his former companies settled a class action over disability insurance.<\/strong><\/p>\n<p>There was indeed a settlement and there is a <a href=\"http:\/\/www.healthextrassettlement.com\/\">website<\/a> documenting the lawsuit.\u00a0 The <a href=\"http:\/\/www.healthextrassettlement.com\/DocumentHandler.ashx?DocPath=\/Documents\/261_1_Exhibit_1_Further_Amended_Complaint.pdf\">complaint<\/a> alleges a variety of violations related to disability insurance sold by one of Blair\u2019s companies that was endorsed by former actor Christopher Reeve.\u00a0 But Blair himself did not settle the case: he sold the company in 2012 and the suit was <a href=\"http:\/\/www.healthextrassettlement.com\/DocumentHandler.ashx?DocPath=\/Documents\/DE_289_Bar_Order_entered_by_Court_4_13_17.pdf\">settled five years later<\/a>.\u00a0 That means one or more of the successor entities and\/or co-defendants made the decision to settle, and if Blair thought the suit was without merit, he did not get to decide whether to fight it at trial.\u00a0 Finally, a settlement does not equate to a trial verdict in determining the truth of a complaint \u2013 indeed, the whole point of a settlement is to avoid trial and a finding of fact either way.\u00a0 The Blair campaign commented on the suit <a href=\"https:\/\/blairformontgomery.com\/facts\/#BusinessLawsuit\">here<\/a>.<\/p>\n<p><strong>\u201cBlair\u2019s company jacked prescription drug prices.\u201d<\/strong><\/p>\n<p>This is a key claim in <a href=\"https:\/\/www.youtube.com\/watch?time_continue=19&amp;v=99gu_mUqXWM\">Progressive Maryland\u2019s TV ad<\/a> and it is based on one 2012 opinion article in the Daily Kos.\u00a0 Now let\u2019s reflect on the nature of the Daily Kos.\u00a0 It\u2019s a liberal opinion blog that allows content submissions from thousands of people without the editorial standards of traditional journalistic organizations like the New York Times or the Washington Post.\u00a0 The site\u2019s <a href=\"https:\/\/www.dailykos.com\/terms\">terms of use<\/a> state:<\/p>\n<blockquote><p>We are an Internet Service Provider, e.g., We are Not Responsible For and Do Not Necessarily Hold the Opinions Expressed by Our Content Contributors.<\/p>\n<p>It should go without saying that with hundreds of thousands of registered users, and tens of thousands of diarist\/bloggers, there is great diversity in thoughts and opinions. So just because you read it on the site doesn\u2019t mean \u201cthe site\u201d said it or thinks it. That would make for a very schizophrenic site.<\/p><\/blockquote>\n<p>The Daily Kos itself does not represent its content as fact-based.\u00a0 Accordingly, without further investigation, an opinion corporate researcher and a political writer, your author is acquainted with the standards of defamation when applied to public figures.\u00a0 Briefly put, a public figure (like a celebrity or politician) can only win a defamation judgment against a defendant if the defendant knowingly made a false statement or made a statement with \u201creckless disregard for the truth.\u201d<\/p>\n<p>This came up all the time in my work for the labor movement as fortifying our communications against defamation suits was a very high priority.\u00a0 For everything we said about a targeted employer, I had reams of paperwork (usually court records) to back it up.\u00a0 I am confident that my union\u2019s attorneys would have blocked me from using something like the Daily Kos article unless I had interviewed the author and acquired documents to back up his or her statements.\u00a0 And even then, our attorneys probably would have still blocked it as unverified by a traditional media organization, government entity or court.<\/p>\n<p>Finally, the way in which Progressive Maryland\u2019s ad characterizes the settlement and the Daily Kos post is very problematic.\u00a0 The ad said, \u201cBlair\u2019s company jacked prescription drug prices and another company sold virtually worthless disability claims.\u201d\u00a0 It would be truthful to say that Blair\u2019s companies were <em>accused<\/em> of these things.\u00a0 But allegations from settled claims that were not decided in court and an opinion blog post should not be characterized as objective facts.\u00a0 It\u2019s these kinds of loose standards that make people so skeptical of political ads.<\/p>\n<p><strong>David Blair is equivalent to Donald Trump.<\/strong><\/p>\n<p>This one has been made in both negative TV ads and by Blair critics too numerous to count.<\/p>\n<p><em>Another still shot from Progressive Maryland\u2019s ad.<\/em><\/p>\n<p><a \/><\/a><\/p>\n<p>Equating Blair to Trump fundamentally misjudges the nature of Trump.\u00a0 If Trump\u2019s sole failings were his wealth and inexperience, he would be no different from all the many other self-funders who run for office.\u00a0 The <em>real<\/em> reason why Trump is the Anti-Christ of progressive politics is that he is a vicious racist, misogynist and xenophobe whose narcissism is matched only by his greed and stupidity.\u00a0 He is literally <a href=\"https:\/\/www.cnn.com\/2018\/06\/18\/politics\/immigration-trump-congress-family-separation\/index.html\">separating children from their parents<\/a> and <a href=\"https:\/\/www.cnn.com\/2018\/06\/14\/us\/inside-immigrant-children-shelter-brownsville-texas-invs\/index.html\">jamming them into detention centers<\/a>.\u00a0 And that\u2019s just a start!\u00a0 Saying that Blair is the same as Trump is over the top.<\/p>\n<p><em>Trump is <\/em><a href=\"http:\/\/www.jacksonfreepress.com\/photos\/2018\/jun\/18\/32039\/\"><em>holding immigrant children in cages<\/em><\/a><em> like this one.\u00a0 David Blair is not Donald Trump.<\/em><\/p>\n<p><a href=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Immigration-Holding-Facility_U.S.-Customs-and-Border-Protections-Rio-Grande-Valley-Sector-via-AP_web_t670.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-11181\" src=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Immigration-Holding-Facility_U.S.-Customs-and-Border-Protections-Rio-Grande-Valley-Sector-via-AP_web_t670.jpg\" alt=\"\" width=\"670\" height=\"390\" sizes=\"auto, (max-width: 670px) 100vw, 670px\" \/><\/a><\/p>\n<p>Our judgment on Blair is that he has his liabilities, especially being a former Republican and desiring high office without prior elected experience.\u00a0 It\u2019s understandable that voters might choose to oppose him on those grounds alone.\u00a0 But critiques of his business record pale in comparison to the dozens of investigations your author conducted in the labor movement.\u00a0 And his critics\u2019 claims that he is equivalent to Trump are out of bounds.\u00a0 Furthermore, we give him credit for <a href=\"https:\/\/www.theseventhstate.com\/?p=10614\">highlighting economic competitiveness<\/a> as one of his core themes as it aligns with our many concerns on that issue.<\/p>\n<p>Whatever its
