Happens if There is a Tie?"},"content":{"rendered":"<p><em>By Adam Pagnucco.<\/em><\/p>\n<p>With hundreds of races for state and county office all over Maryland this year, some of them are bound to be close.\u00a0 In fact, it\u2019s even possible that there could be a tie.\u00a0 Don\u2019t laugh, readers \u2013 <a href=\"https:\/\/www.washingtonpost.com\/local\/virginia-politics\/republican-yancey-picked-in-random-lottery-declared-winner-of-pivotal-va-house-race\/2018\/01\/04\/9c9caa5a-f0a1-11e7-b390-a36dc3fa2842_story.html?utm_term=.766a79c58fe0\">that actually happened in a Virginia House of Delegates race last year<\/a>, with the winner\u2019s name plucked from a bowl and partisan control of the chamber resting on the outcome.\u00a0 So if a tie occurs in Maryland, what would happen?<\/p>\n<p>The issue appears in five sections of the state\u2019s constitution.\u00a0 Article II, Section 4 refers to a tie in a race for Governor and Lieutenant Governor.\u00a0 If that happens, the election is decided by a vote of the General Assembly.<\/p>\n<p><a href=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Tie-Gubernatorial-Election.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-10981\" Section 13 refers to a tie in a General Assembly election.\u00a0 If that happens, the party Central Committee of the same party as the last occupant of the office determines the winner.\u00a0 The procedure is similar to filling legislative vacancies.<\/p>\n<p><a href=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Tie-General-Assembly.png\"><img loading=\"lazy\" states that if there is a tie in an election for the state&#8217;s Attorney General, the Governor decides the winner.<\/p>\n<p><a states that a tie in an election for a State&#8217;s Attorney will be decided by the judges with criminal jurisdiction in the relevant county.<\/p>\n<p><a href=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Tie-States-Attorney.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-10984\" and county office are covered by Article XVII, Section 8.\u00a0 If any of them results in a tie, \u201ca new election shall be ordered by the Governor, except in cases specially provided for by this Constitution.\u201d<\/p>\n<p><a href=\"https:\/\/www.theseventhstate.com\/wp-content\/uploads\/2018\/06\/Tie-State-County-Election.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone are not mentioned in the constitution, but the issue came up in 2015 when a city council election in Aberdeen resulted in a tie.\u00a0 Prior to that, the Maryland Municipal League <a href=\"https:\/\/www.heraldmailmedia.com\/instant\/it-s-a-draw-now-what-solving-an-election-tie\/article_2808e65c-613c-11e8-bd33-83a708bec96f.html\">found that there had been eight ties in municipal elections over the last decade<\/a>.\u00a0 Some municipalities had no procedures for resolving ties.\u00a0 The incident led to the passage of a <a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmMain.aspx?pid=billpage&amp;stab=01&amp;id=HB0852&amp;tab=subject3&amp;ys=2016RS\">2016 state bill<\/a> specifying that municipalities must have tie-breaking procedures but leaving to them the decision of what to choose.<\/p>\n<p>So there you have it, folks.\u00a0 With all of the heavily contested races in the state this year, there\u2019s a
